Thenward, trading as Gypsy Bits, is committed to the protection of your personal information.

The website, gypsybits.com.au does not and will not in itself collect, send, distribute, sell, or store in any other location, any of your private information.

As the website and the online shopping feature of the site is powered by Shopify, this organisation has its own policies regarding data privacy.

The policies can be found at shopify.com/legal/privacy/customers.

We recommend that you visit this site to familiarise yourself with their policies.

Shopify may collect and hold some information about you in their system however, Gypsy Bits will not ask for it to be provided nor use this data for any purpose.

The only occasion in which you may receive marketing information from us is if you should decide to provide your email address in our website specifically to receive direct updates from us from time to time.

Gypsy Wheel App Privacy Policy

The details contained in this page are intended to inform you about our policies, the use and disclosure of any information we collect.

The Gypsy Bits/Gypsy Wheel App is intended to be the interface between an individual Gypsy Wheel device and the owner/user of that device.

No data is collected or transmitted to any third party. 

The Gypsy Wheel device incorporates a Bluetooth transmitter which relays the weight measurement determined in the Gypsy Wheel itself to the user’s smart phone or other Bluetooth enabled device.

This is for the purpose of displaying the weight measurement in a convenient way on the user’s device only.

The App includes a unique formula which enables the calculation of the weight at a distance away from the position of the Gypsy wheel itself. Two of the inputs for the calculation are entered by the user and the third input is the weight transmitted from the Gypsy Wheel.

When the Tow Ball weight option is selected and the two user input dimensions are entered, the App calculates the weight at the selected point on the trailer, usually the tow ball point.

Gypsy Wheel Product Warranty

Preface

Our Gypsy Wheel provides the guarantees that cannot be excluded under the Australian Consumer Law. Nothing in this warranty is to be interpreted as excluding, restricting or modifying any State or Federal legislation applicable to the supply of goods and services which cannot be excluded, restricted or modified.

Thenward (ABN 4162 713 013) trading as Gypsy Bits ("Gypsy Bits”) provides the following warranty in relation to its Gypsy Wheel product ("Product").

You are entitled to a replacement or refund for a major failure. You are also entitled to have the goods repaired or replaced at the discretion of Gypsy Bits if the goods fail to be of acceptable quality and performance.

The benefits of this warranty are in addition to any rights and remedies imposed by Australian State and Federal legislation that cannot be excluded.

Warranty

Gypsy Bits warrants that, subject to the exclusions and limitations below, the Product will be free from defects in materials and workmanship for a period of 12 months from date of purchase.

This warranty is not transferable to a subsequent person if the Product is on sold by the original purchaser during the warranty period.

If a defect should appear in the Product before the end of the warranty period and Gypsy Bits finds the Product to be defective in materials or workmanship, Gypsy Bits will, in its sole discretion, either:
(a) replace or repair the Product or the defective part of the Product free of charge, or;
(b) cause the Product or the defective part of the Product to be replaced or repaired by a qualified repairer free of charge.

Gypsy Bits reserves the right to replace defective parts of the Product with parts and components of similar quality, grade and composition where an identical part or component is not available.

Goods presented for repair may be replaced by refurbished goods of the same type rather than being repaired. Refurbished parts may be used to repair the goods.

Warranty Claims

1. If a fault covered by warranty occurs, the customer must contact the dealer within 7 days from which the Product was purchased, or Gypsy Bits directly at the contact address listed below.

2. Any warranty claim must be accompanied by:
(a) proof of purchase;
(b) full details of the alleged defect;
(c) any relevant documentation (such as maintenance records), and, if applicable;
(d) photographs depicting the fault.

3. The customer must make the Product available to Gypsy Bits or its authorised repair agent for inspection and testing within 14 days of contacting Gypsy Bits or the dealer in accordance with this warranty claims procedure. If inspection and testing finds no defect in the Product, the customer must reimburse Gypsy Bits for the costs of service work and testing.

4. The cost of transportation to or from Gypsy Bits or the authorised repair agent is to be paid by the customer.

Exclusions

The warranty will not apply where:

(a) the Product has been repaired, altered or modified by someone other Gypsy Bits or an authorised repair agent;
(b) the Product was improperly installed;
(c) Gypsy Bits cannot establish any fault in the Product after testing and inspection;
(d) the Product has been used other than for the purpose for which it was designed;
(e) the defect in the Product has arisen due to the customer's failure to properly use and maintain the Product in accordance with Gypsy Bits' instructions, recommendations and specifications (including maintenance if applicable);
(f) the Product has been subject to abnormal conditions, including environment, temperature, water, fire, humidity, pressure, stress, impact or similar;
(g) the defect has arisen due to abuse, misuse, neglect or accident;
(h) the defect has arisen due to a power issue or other fault in the supply of power by the incorrect installation of, or incorrect type replacement of the battery; or
(i) unauthorised parts or accessories have been used on or in relation to the Product;
(j) the defect is a deterioration of the appearance of the Product, or;
(k) the defect is a result of wear & tear.

Limitations

Gypsy Bits makes no express warranties or representations other than set out in this warranty. The repair or replacement of the Product or part of the Product is the absolute limit of Gypsy Bits' liability under this express warranty and no other claim for loss or damage as a result of any fault will be considered.
